Indeed, I've represented clients with broken hips, fractured wrists, brain injuries, and back problems that never fully went away, all from falls that started as something as ordinary as a wet floor or missing a step because the stairways were too dimly lit. Here's the part that frustrates me most: a lot of people who get hurt this way never call a lawyer. They assume it was their own fault. They assume it's too complicated to pursue. The Four Things You Have to Prove

The point is, it doesn't make much difference to the insurance company. What matter is that regardless of the reason, within days of the crash, an adjuster is already building a file that asks,

Why you were where you were?
What were you looking at when you were struck?
Why didn't you take evasive action to avoid getting hit by the car?
Why didn't you look both direction, twice?
Why were you wearing clothing that was not reflective or noticeable?
Were you on your phone talking or texting?
Why did you step out into the roadway unexpectedly?

Why Pedestrian Cases Get Contested So Aggressively

Pedestrian accidents tend to produce serious injuries because there's nothing between a person's body and a moving vehicle, and nothing between the person's body and the ground.

What California Law Actually Says

Under California law, drivers owe pedestrians a duty of reasonable care, and that duty is heightened in specific situations: Crosswalks, marked or unmarked. Drivers must yield to pedestrians who are lawfully crossing, whether the crosswalk has painted lines or is simply the unmarked extension of a corner. A lot of people don't realize unmarked crosswalks legally exist at nearly every intersection. Turning vehicles. A driver making a left or right turn must yield to pedestrians already crossing, even if the driver has a green light. School zones and residential streets. Drivers are held to a stricter standard around schools, parks, and neighborhoods where children are more likely to be present. Backing up in parking lots. Drivers backing out of a space or driving through a parking lot must watch for pedestrians walking between cars, a common source of injury claims I see from Valencia Town Center and similar shopping areas. However, none of this means a driver is automatically liable just because a pedestrian was hit. But it does mean the legal presumption often favors the pedestrian, and insurance companies know that. So, their whole strategy is to find facts that flip that presumption, which is exactly why documentation and a fast investigation matter so much.

What If You Were Partly at Fault?

This question comes up constantly, and it stops people from calling an attorney when they shouldn't let it. Maybe you were crossing mid-block. Maybe you didn't see the car coming. Maybe you were speeding. Whatever the reason, you may be partially at fault, but it doesn't mean that you not entitled to compensation. An official accident report is one of the strongest pieces of evidence you can have, and it captures details from the scene while they're still fresh. Get the driver's information. The the driver's name, license number, insurance, and license plate, and take photos of the vehicle, the intersection, and any relevant signals or signage. Get witness contact information. Pedestrian cases often come down to conflicting accounts of who had the right of way. An independent witness can be the difference-maker. Don't give a recorded statement to the driver's insurance company without talking to an attorney first. An adjuster representing the insurance company will ask questions designed to get you to say something that sounds like an admission of fault. I've seen perfectly strong cases weakened by a five-minute phone call taken too early. Don't accept an early settlement offer. Adjusters move fast on pedestrian cases specifically because the injuries tend to be severe, and they want to lock in a number before you know the full extent of your medical needs.

What Uber and Lyft Don’t Want You to Know After a Rideshare Accident in California

Here's a question I get more often than you'd think: "The other driver was working for Uber when they hit me. So, Uber's insurance covers it, right?"

Sometimes yes and sometimes no, and the difference can be significant.

Before I represented injured people, I spent years on the defense side, and one thing I learned is that rideshare claims are built around a coverage structure most people have never heard of, and companies like Uber and Lyft are not in a hurry to explain it to you.

It's not illegal for them to stay quiet. It's just good business for them and a bad surprise for you.

The Three Periods of Rideshare Coverage

California law treats a rideshare accident differently depending on exactly what the driver's app was doing at the moment of the crash. There are three distinct "periods," and each one carries a different level of insurance:

1. App Off. If the driver hasn't logged into the Uber or Lyft app, they're just a regular driver in their own car. Only their personal auto insurance applies, and if they were using a personal policy that excludes commercial or rideshare use (many do), you could be looking at a real coverage gap. 2. App On, Waiting for a Ride Request. Once the driver logs in and is waiting to be matched with a passenger, California law requires Uber and Lyft to provide contingent liability coverage, but at much lower limits than you'd expect: typically $50,000 per person / $100,000 per accident for injuries, and $30,000 for property damage. If your medical bills are significant, this tier can run out fast. 3. En Route or During a Trip. Once the driver accepts a ride request, is en route to pick up a passenger, or has a passenger in the car, Uber and Lyft are required to provide up to $1 million in liability coverage. This is the tier most people assume applies to every rideshare accident, and it's the one the companies are least eager to volunteer information about when it doesn't.

How This Coverage Structure Came to Be

This isn't something Uber or Lyft came up with on their own out of generosity. California's tiered coverage requirements for Transportation Network Companies (TNCs) come out of state legislation and California Public Utilities Commission (CPUC) rules adopted after rideshare companies first exploded onto the scene and lawmakers realized personal auto policies were never designed to cover someone driving strangers around for money.

The tiered system was a compromise: low coverage while a driver waits for a match, and much higher coverage once a driver is actively engaged in a trip.

Knowing that this structure exists because regulators forced it into being, not because Uber or Lyft volunteered it, tells you something important: these companies comply with the letter of the law, but they have no obligation to make the process easy for an injured person to navigate. That part is left entirely up to you, or to whoever you hire to sort it out.

A Scenario I See Often

Picture this: an Uber driver has just dropped off a passenger and is driving home for the night with the app closed. On the way, they run a red light and crash into another vehicle.

Because the app was off at the moment of impact, Uber's insurance likely doesn't apply at all and this falls back entirely on the driver's personal auto policy, which may have limits far lower than what's needed to cover a serious injury.

Now change one fact: the driver hadn't logged off yet and was technically still "available" for a match, even though no passenger was in the car. Suddenly the $50,000/$100,000 contingent coverage period applies.

Change the facts one more time: the Uber driver had just accepted a new ride request and was en route to pick someone up. Now, the $1 million policy kicks in.

Same driver. Same car accident. Same intersection. Three completely different insurance outcomes, separated by nothing more than the status of an app most people never think to check. This is exactly why the trip data matters so much, and why it needs to be requested and preserved before it can be lost or disputed.

Why This Matters More Than You'd Think

Here's what I saw on the defense side, and what still plays out today:

Insurance adjusters, whether they represent the rideshare company's carrier (i.e. Uber, Lyft or some other rideshare company), or the driver's own personal insurer, know exactly which period applies before you do.

They also know that injured people often don't ask the right questions, don't request the trip data that proves which period was active, and accept an early, low offer because it's the only number anyone has given them.

If you were a passenger, a pedestrian, a cyclist, or in another vehicle when a rideshare driver hit you, the burden often falls on you to establish which insurance tier applies, using trip logs, driver app status, and timestamps that Uber and Lyft control. Without that data pulled and preserved quickly, you're negotiating from a position of not knowing what you're even entitled to.

What to Do After a Rideshare Accident

- Get medical care immediately, even if you feel "okay." Adrenaline hides injuries, and a treatment gap gives insurers an easy argument that you weren't really hurt. - Document the ride. Screenshot the trip details in the app, including the driver's name, timestamps, and route, before anything changes or expires. - Don't give a recorded statement to any insurance company, rideshare or otherwise, before speaking with an attorney. What you say early gets used to minimize what you're owed later. - Report the accident through the Uber or Lyft app's safety reporting feature, which creates a documented record tied to the specific trip. - Get legal help before accepting any settlement offer. The company or driver's insurer is not going to volunteer which coverage tier applies or whether a higher one is available.

The Bottom Line

Rideshare accidents look simple on the surface. People think, "Uber driver hit me, Uber must cover it".

But the coverage structure underneath is anything but simple, and it was built with the rideshare companies' liability exposure in mind, not your recovery. Knowing which of the three periods applies, and being able to prove it, is often the single biggest factor in what a rideshare injury claim is actually worth.

There's a moment that happens in almost every personal injury case, usually about two weeks after the accident.

The adjuster calls. They're friendly. They ask how you're feeling. They mention they just want to "get this wrapped up quickly" so you can move on with your life.

I want to tell you what's actually happening in that conversation, because for almost ten years, I was on the other side of it. Before I represented injury victims, I represented drivers, contractors, property owners, and bus companies. I sat in the strategy meetings. I read the claims-handling manuals. I know exactly what that adjuster's file looks like.

It's not because they've decided to take care of you. It's because they're hoping to settle your claim before you understand how serious your injuries actually are. I'm Mason with The Mason Law Firm, and I want to walk through why this happens, the tactics insurance companies use, and what you should know before you sign anything after a California car accident.

Insurance Companies Are Businesses First

It's easy to forget this in the moment, especially when the person on the phone sounds warm and reasonable. But insurance companies exist to protect their profits, not your recovery. Every adjuster you speak with is, at the end of the day, evaluating your claim against a budget and a set of internal targets for how quickly and how cheaply it can be resolved. One of the best outcomes for them is getting an injured person to settle quickly before treatment is finished, before symptoms fully develop, and before the true value of the claim becomes clear. A lot of people assume a fast offer means the insurance company is trying to help. In reality, it's usually the opposite. A quick settlement is often designed to close the case cheaply, and that's especially true in California, where the value of a claim can grow substantially as medical treatment continues and the long-term impact of an injury becomes apparent. The longer a claim stays open, the more visibility everyone has into the real cost of the injury, such as lost wages, ongoing therapy, permanent limitations. Insurance companies know this, which is exactly why they'd rather you sign before that picture comes into focus. This isn't a coincidence or an occasional bad actor. It's a business model. Adjusters are often evaluated internally on how efficiently they close files and how far below the claim's potential value they're able to settle. That doesn't mean every adjuster is acting in bad faith on a personal level. In fact, many are just doing their job within a system built to minimize payouts. But it does mean you shouldn't mistake friendliness for fairness.

Why "I Feel Fine" Right After an Accident Doesn't Mean You Are

One of the most common mistakes I see is people assuming they're okay in the immediate aftermath of a crash. Adrenaline can mask pain for days, and some of the most serious injuries take time to show up, injuries including:

Whiplash
Herniated discs
Concussions and traumatic brain injuries
Nerve damage
Anxiety or PTSD following the crash

I've represented clients who genuinely believed they were fine at the scene, only to discover weeks later that they needed injections, physical therapy, or even surgery. If you settle before the full extent of your injuries becomes clear, you may be giving up your right to recover for any future medical treatment, and once you accept a settlement, there's typically no going back. Part of the reason these injuries take time to surface comes down to basic physiology. In the moments after a collision, your body releases a flood of adrenaline and other stress hormones designed to help you cope with an immediate threat. That chemical response is very good at suppressing pain signals, which is why so many people walk away from a crash saying they feel "shaken up but okay." It's only once that adrenaline wears off, sometimes hours later, sometimes the next morning, that stiffness, swelling, and real pain start to set in. Soft-tissue injuries in particular, like whiplash, often don't peak until 24 to 72 hours after the impact. This is exactly why insurance companies move fast. If an adjuster can get you to describe your injuries, or accept an offer, during that early window, before the adrenaline fades and before you've even seen a doctor, they're locking in a valuation based on incomplete information. That's not an accident. It's timing.

Common Tactics Insurance Adjusters Use

Adjusters are trained professionals, and their approach is rarely accidental. You should delay speaking with an adjuster until you seek advice from a personal injury attorney. Here are a few tactics to watch for: Asking for a recorded statement. It can feel casual, even friendly, but recorded statements are frequently used to lock in language that can later be used against you. Minimizing your injuries. Comments like "it sounds like you're feeling better" or "this seems like a minor accident" often come well before your treatment is anywhere near complete. After an accident, never tell an adjuster that you feel fine! Offering quick money. When medical bills are stacking up, a fast check can be tempting. But early offers are typically far below what a case is actually worth. Discouraging you from hiring an attorney. You may hear "you don't need a lawyer for this." Keep in mind: the insurance company already has professionals working to protect its interests. You deserve the same.

Why a Settlement Is (Almost Always) Final

Here's the part that catches many people off guard: when you accept a settlement, you typically sign a release, and that release usually closes your case permanently. It doesn't matter if your injuries get worse, if you end up needing surgery down the road, or if new medical issues surface later, once you've signed, you generally cannot go back and ask for more. That's precisely why it matters so much to understand the full scope of your injuries before you agree to settle anything.

Steps to Take After a California Car Accident

1. Get medical attention first. Your health comes before anything else. Follow your doctor's recommendations, and understand that gaps in treatment can hurt both your recovery and your claim. 2. Document everything. Keep records of medical visits, symptoms, missed work, and how the injury is affecting your daily life. 3. Be careful talking to the insurance company Avoid speaking with the adjuster from the adverse insurance company until you fully understand the extent of your injuries. However, should you speak with him or her, tell them that you will not discuss your injuries until you speak with an attorney. 4. Talk to an experienced personal injury attorney The only way to protect yourself is to consult with an experienced Personal Injury attorney, and never sign any paperwork, especially any settlement documents until you do.

How Does a Personal Injury Lawyer Decide What Your Case Is Worth?

One of the most common questions I hear from clients is:

"How did you come up with that settlement demand?"

Recently, I represented a client whose medical bills totaled just under $20,000. After carefully reviewing the case, we prepared a settlement demand asking the insurance company for $150,000.

Before we sent the demand, I reviewed it with my client. He looked at me and asked:

"Where did you come up with $150,000?"

It's a fair question. In fact, I've even had attorneys who don't practice personal injury law ask me the same thing.

The answer often surprises people.

There is no magic formula.

There isn't a computer program that tells us what your case is worth, and I don't simply multiply your medical bills by a certain number. Determining the value of a personal injury case requires experience, judgment, and a careful evaluation of many different factors.

Every Case Starts with Liability

Before I can determine the value of a case, I first need to determine how strong liability is.

That begins by asking:

Was it a car accident?
Was it a slip and fall?
Was it a dog bite?
Was it a burn injury?
Was it another type of negligence case?

This is important because each type of case presents different legal issues.

For example, slip and fall cases often involve proving that the property owner knew, or should have known, about a dangerous condition before the accident occurred. That notice requirement is frequently disputed.

On the other hand, dog bite cases in California are generally governed by strict liability, meaning liability is often much easier to establish.

The strength of liability directly impacts the settlement value of a claim.

The Type of Accident Matters

If the case involves a motor vehicle collision, I also evaluate how the accident occurred.

Questions include:

Was it a rear-end collision?
Was it a T-bone accident?
Was it a head-on collision?
Was it a sideswipe accident?

Different collisions produce different injury mechanisms. This is important because we have to prove a causal connection between the accident and our client's injuries.

For example, a rear-end collision commonly causes whiplash and other soft tissue injuries, while a high-speed T-bone or head-on collision is generally more likely to produce fractures, traumatic brain injuries, or other objective injuries.

Understanding how the collision occurred helps explain why certain injuries developed.

The Injuries Are Critical

Next, I carefully evaluate the injuries themselves.

Some of the questions I ask include:

Was the client transported by ambulance?
Did they go to the emergency room?
How soon did treatment begin?
Did they receive physical therapy?
Were injections necessary?
Was surgery performed?
Are there objective findings on MRI, CT scan, or X-rays?

Objective medical findings typically strengthen an injury claim because they provide evidence beyond the client's complaints of pain.

Medical Bills Tell Only Part of the Story

Many people assume the value of a case is determined simply by adding up medical bills.

That is not how experienced personal injury attorneys evaluate claims.

I certainly review the amount of the medical bills, but I also examine what those bills represent.

For example:

How much was spent on actual treatment?
How much was spent on diagnostic testing?
Has treatment been consistent?
Has the client reached maximum medical improvement?

Generally speaking, medical bills reflecting meaningful treatment often carry more weight than bills consisting primarily of diagnostic testing.

Property Damage Can Influence Perception

In automobile cases, I also evaluate the property damage.

Now let me be clear: Vehicle damage does not determine whether someone is injured.

I've represented clients with significant injuries even though their vehicles sustained relatively minor damage.

However, juries are human.

So, photos of severe vehicle damage often reinforce the seriousness of a collision, while minimal damage frequently becomes an argument insurance companies use to challenge the extent of the injuries.

Although there is no direct relationship between vehicle damage and bodily injury, it can influence how a case is perceived.

Every Client Is Different

The client is just as important as the injuries.

I consider factors such as:

Age of the client
Our client's overall health before the incident
Whether the injuries are permanent
Whether there is scarring or disfigurement
The impact on work, hobbies, and daily life

For example, permanent facial scarring may affect different people in different ways depending on their age, occupation, and circumstances.

I also take time to understand each client's personal story.

Every client has a different reason for pursuing a claim. Some simply want their medical bills paid, while others are primarily concerned about future medical care, lost income, or the lasting impact the injuries have had on their lives.

Understanding those goals helps shape our settlement strategy.

Credibility Matters

Another factor many people overlook is "credibility".

If a case ultimately goes to trial, or even to a deposition, I need to evaluate how the client will present to a jury, or a defense attorney who will evaluate the client as a witness at his or her deposition.

Jurors tend to respond well to witnesses who are:

Honest
Likeable
Consistent
Credible

A strong, likable, believable witness can significantly increase the value of a case. For example, the value of a case for four year girl who was mauled by a dog is generally higher than a case for a 75 year old male.

Insurance Companies Are Not All the Same

People often assume every insurance company evaluates claims the same way.

They don't.

So, I also consider:

Which insurance company is handling the claim?
Which regional claims office has the file?
Is it a self-insured Defendant?
Whether the claim is against another driver or under my client's uninsured/underinsured motorist coverage.
Current trends within the insurance industry.

These factors often affect how negotiations proceed and how an opening demand should be presented.

Why the Opening Settlement Demand Matters

Once I have evaluated all of these factors, I determine an opening settlement demand that strikes the right balance.

The goal is twofold.

First, it gives my client enough room to negotiate toward a fair settlement.

Second, it is supported by the facts, medical evidence, and applicable law so that the insurance company takes the demand seriously and engages in meaningful settlement discussions.

An opening demand should never be an arbitrary number. It should reflect a thoughtful evaluation of the case while positioning the client for successful negotiations.

Experience Makes the Difference

When someone asks me how I arrived at a $150,000 settlement demand on a case involving approximately $20,000 in medical bills, the answer is simple.

I didn't multiply the medical bills by a certain number.

I evaluated every factor that could influence the outcome of the case.

That approach comes from experience.

Burn Injury Claims in California: What I Learned on the Defense Side and Why It Matters to You

For nearly three decades, I have handled serious injury cases in Santa Clarita, Valencia, and across Los Angeles and Orange County. Before I represented injured people, I spent years on the defense side, defending contractors, property owners, and others against the very claims I now bring.

That background shapes everything about how I handle a burn case, because few injuries are fought as hard by insurers, or misunderstood as often by the people who suffer them.

A burn is not just a wound that heals and fades. A serious burn is a lifelong event. It can mean repeated surgeries, skin grafts, infection risk, permanent scarring, disfigurement, nerve damage, and a degree of physical and emotional suffering that most other injuries simply do not produce.

The medical bills for burn injuries are also enormous, the recovery is long, and the consequences follow a person for the rest of their life. Insurance companies know all of this and that knowledge is exactly why they work so hard to pay you as little as possible.

This article explains how burn injuries happen, who can be held responsible under California law, and most importantly, what the insurance company is doing behind the scenes to reduce or deny your claim.

How serious is the problem?

Burn injuries are far more common than most people realize. The American Burn Association estimates that roughly 600,000 people in the United States suffer a burn serious enough to require emergency care each year.

Survival rates for hospitalized burn patients now exceed 97 percent, which is good news, but survival is not the same as recovery. Many survivors face months of treatment and a lifetime of consequences.

The Association's data on hospital admissions also tells you something useful about how these injuries occur. The leading cause is:

Flame or flash burns (roughly 42 percent),
Scalds from hot liquids and steam (about 32 percent),
Contact with hot objects (about 11 percent),
Chemical burns (roughly 4 percent), and
Electrical burns (around 3 percent).

Burn admissions also spike in the warmer months from May through August. California, with its dense population, year-round construction activity, and recurring wildfire seasons, consistently ranks among the states with the highest number of fire-related injuries and deaths.

Understanding burn severity

Not all burns are alike, and the legal value of a case is closely tied to how deep the damage goes. Doctors generally classify burns by degree:

Degree	What it affects	Typical signs	Long-term outlook
First degree	Outer layer of skin only (epidermis)	Redness, mild pain, no blistering	Usually heals on its own within days
Second degree	Epidermis and part of the underlying dermis	Blistering, swelling, intense pain	May scar; deeper second-degree burns can require grafting
Third degree	Full thickness of the skin	White, leathery, or charred skin; often numb due to nerve damage	Almost always requires surgery and grafting; permanent scarring
Fourth degree	Through the skin into muscle, tendon, or bone	Charring, loss of function	Catastrophic; may require amputation; lifelong disability

There is an important and counterintuitive point hidden in that table. A third-degree burn can be less painful at first than a second-degree burn, because the nerve endings have been destroyed.

So, burn victims sometimes underestimate their injury in the first hours after an accident and insurance adjusters are happy to let them.

How burn injuries happen here in the Santa Clarita Valley

In my practice, burn cases tend to arise from a handful of recurring scenarios:

Vehicle collisions.

Fires and chemical burns from airbags, fuel, and battery systems can turn a survivable crash into a catastrophic burn injury.

Premises-related burns.

Scalding water in apartments and hotels, restaurant accidents, unsafe heating equipment, and apartment and structure fires caused by landlord neglect, faulty wiring, missing or disabled smoke detectors, code violations, all give rise to premises liability claims.

Example of a case we handled: Our client was a six-year old boy who fell into an open fire pit. He sustained 3rd degree burns on 80% of his body. As if that wasn't bad enough, his four-year sister witnessed the incident, and kept having recurrent dreams about her brother being on fire.

Construction and workplace accidents.

This is the area I know well. On a job site, burns come from electrical contact and arc flash, exposed steam or hot fluids, chemical exposure, flammable materials, and equipment that was poorly maintained or missing safety guards.

Arc-flash incidents in particular can produce devastating burns in a fraction of a second. Because I spent years defending contractors, I know how these companies investigate accidents, what their safety records actually show, and where the documentation tends to fall apart.

Defective and dangerous products.

Faulty wiring, overheating lithium-ion batteries, exploding e-cigarettes and vape devices, unsafe water heaters, flammable consumer goods, and industrial equipment with inadequate guarding or warnings all cause burns. These are product liability cases, and California law is favorable to injured consumers here.

Example of a case we handled: We helped a client who suffered second degree burns from hot tea served to her at a Starbucks drive-thru. The incident occurred because the lid of the hot beverage was not properly placed.

Who is responsible under California law?

California gives burn victims several routes to recovery, and the right case often involves more than one.

Negligence.

This is the foundation of most injury claims. If a person in an accident, a landlord or owner affiliated with a certain premises, or a company failed to use reasonable care and that failure caused your burn, they can be held liable for your injuries.

Premises liability.

Property owners and businesses owe a duty to keep their premises reasonably safe and to warn of known hazards. When an unsafe condition, such as bad wiring, scalding tap water, or a missing smoke detector causes a burn, the owner may be responsible.

Product liability.

California applies strict liability to defective products. That means you generally do not have to prove the manufacturer was careless, only that the product was defective and that the defect caused your injury. A defect can be in the product's design, its manufacture, or in its failure to carry adequate warnings.

Workplace burns and the third-party claim.

This is where my defense experience pays real dividends for clients. If you are hurt on the job, workers' compensation is usually your exclusive remedy against your employer.

However, it is often not the end of the story. On a construction site especially, you may also have a separate "third-party" liability claim against other negligent parties, including the general contractor, another subcontractor, the property owner, or the manufacturer of a defective piece of equipment.

These third-party claims allow recovery for pain, suffering, and disfigurement that workers' compensation simply does not pay. Identifying every responsible party is often the difference between a modest comp benefit and full compensation.

What the insurance company is really doing

Here is the part most articles leave out, and the part I understand from having lived it.

When you file a burn claim, a defense team and an adjuster go to work, not to make you whole, but to manage their exposure. Having been on that side, I can tell you what they are doing:

They move fast to lock in a low number.

Adjusters love to reach out early, while you are still in the hospital or still in shock, and offer a quick settlement that sounds like a lot of money.

It is rarely close to what a burn case is worth. Once you sign a release, you cannot reopen it, even when the next surgery, the next infection, or the next graft arrives.

They downplay future care.

Burn injuries are expensive precisely because the treatment continues for years: revision surgeries, scar-management procedures, physical therapy, mental-health treatment.

Adjusters routinely value a claim as if the medical care ended at discharge. It almost never does.

They attack causation.

Expect arguments that your scarring "isn't that bad," that a pre-existing condition is to blame, or that the burn would have healed better if you had done something differently.

With chemical and electrical burns, they will dispute exactly how the injury occurred.

They shift blame onto you.

California is a pure comparative negligence state (more on that below), so every percentage of fault they can pin on you directly reduces what they pay.

On a job site, they will argue you ignored a safety procedure. In a product case, they will argue you misused the product. Documenting the scene early, before they do, is critical, which is one reason calling a lawyer quickly matters so much.

They count on you not knowing the full value.

This is the big one. A burn victim who does not understand California damages law will accept a fraction of what their case is worth, and the adjuster knows it.

What your burn claim is actually worth

Under California law, an injured person can recover both economic and non-economic damages.

Economic damages are the measurable financial losses: past and future medical expenses (including future surgeries and lifelong scar treatment), lost wages, and lost future earning capacity if the injury affects your ability to work.

Non-economic damages compensate for pain and suffering, emotional distress, and critically in burn cases disfigurement.

This is where burn cases differ from almost every other injury. Visible, permanent scarring on the face, hands, or body carries substantial non-economic value precisely because it cannot be undone and is carried in public, every day, for the rest of a person's life.

One California wrinkle worth understanding is Proposition 51. Under it, when multiple parties are responsible, each defendant is liable for non-economic damages only in proportion to its own share of fault (several liability), while remaining jointly liable for economic damages.

So, in a multi-defendant case, such as in a construction accident with a general contractor, a sub, and an equipment maker, apportioning fault correctly across every responsible party is essential to maximizing recovery. That is exactly the kind of analysis I built my career on.

A simplified illustration:

The two columns describe the same injury. The difference in outcome is preparation and knowing how the other side thinks.

Two California rules you need to know

The statute of limitations.

In most California personal injury cases, you have two years from the date of injury to file a lawsuit.

There are important exceptions that can shorten or lengthen that window. For example, claims against a public entity (a city, county, or public hospital) generally require a formal claim within six months, and different rules apply to minors.

Miss the deadline and your claim is gone, no matter how strong it was. This is not a deadline to test.

Pure comparative negligence.

California follows a pure comparative fault rule. Even if you are found partly responsible for your own injury, you can still recover, but your award is simply reduced by your percentage of fault.

For example, if you are found 20% at fault, you recover 80% of your damages. This is why insurance companies fight so hard to assign you fault, and why having someone who understands their playbook matters.

Why acting early protects your case

Burn cases are won or lost on evidence, and evidence disappears. The defective product gets discarded. The job site gets cleaned up and the scene changes. Witnesses move on and memories fade. Safety records get "lost."

Not every state treats injured people this way, and the differences are stark: - Pure comparative negligence (California and ~12 others): You can recover even if you're mostly at fault. Your award is reduced by your percentage. - Modified comparative negligence (most states): You're barred from recovering anything once you hit 50% or 51% fault, depending on the state. - Pure contributory negligence (a handful of states plus Washington, D.C.): This is the harshest rule of all. Even 1% at fault can bar your entire claim. California sits firmly on the plaintiff-friendly end of that spectrum. Here's the catch insurance companies count on

However, if a government or public entity is involved, such as a city, the county, or a state agency, you may have as little as six months to file a formal claim. Picture this: It is a normal weekday morning, and you are driving to work. Traffic on the freeway begins to slow and eventually comes to a complete stop. So, you bring your vehicle to a stop behind the cars in front of you, just as any responsible driver would do.

Then, without any warning whatsoever, you are violently struck from behind by a driver who was either distracted, fatigued, driving too closely, or traveling well above a safe speed for traffic conditions.

The force of the impact is so severe that your vehicle is launched forward and pushed into the car directly in front of you.

So, in a matter of seconds, you have absorbed two separate and distinct impacts, one from behind and one from the front. Your body, restrained by a seatbelt, is whipped backward and then thrown forward with tremendous force.

In the immediate aftermath, the adrenaline coursing through your body masks much of what your body has just endured. You step out of your car, check your damage, and exchange insurance and contact information with the other drivers involved.

You feel composed enough to give a statement to the California Highway Patrol officer who comes to the scene. You go to work. You come home, have dinner, and go to bed feeling, by all outward appearances, completely fine.

But when you wake up the next morning, everything has changed. You can barely lift your head off the pillow. Your neck is stiff and aching. You also have a dull but persistent headache.

Your shoulders feel sore, and you notice a faint tingling sensation running down your arms. What you are experiencing is whiplash, and it is far more serious than many accident victims initially realize.

Statistics On Rear-end Collisions and Whiplash Injuries

According to the National Library of Medicine, research on minor rear-end accidents found occupants suffered cervical spine (neck) complaints even at average collision speed changes of only about 6.3 km/h (3.9 mph).

The National Highway Traffic Safety Administration (NHTSA) has also gathered the following crash statistics on whiplash litigation and biomechanics analysis:

What Is Whiplash?

Whiplash is a painful and potentially debilitating neck injury caused by the sudden, forceful backward and forward movement of the neck and head. It is most commonly associated with rear-end car accidents, though it can also result from sports injuries, physical altercations, falls, or any high-impact event that causes the head to jerk rapidly and violently in opposite directions.

To understand why whiplash is so damaging, it helps to understand the mechanics of the injury. During a rear-end collision, the body is abruptly propelled forward by the force of impact while the head, due to its weight and inertia, momentarily lags behind.

This creates a violent snapping or whipping motion in the neck, one that the human body is simply not designed to withstand. The cervical spine (neck) and surrounding soft tissues are subjected to forces far beyond what they would experience under normal circumstances.

This sudden and extreme movement places enormous stress on the muscles, tendons, ligaments, and intervertebral discs that support the neck and head.

In many cases, these structures are stretched, strained, or torn. In more severe cases, nerve damage may occur, and the natural curvature of the cervical spine may be compromised. The result is an injury that can range from short-term discomfort to a chronic, life-altering condition requiring prolonged medical treatment.

What Are the Common Symptoms of Whiplash? They Include:

- Neck pain and stiffness, often severe enough to significantly restrict movement - Persistent headaches, particularly at the base of the skull - Shoulder and upper back pain - Dizziness and difficulty with balance - Fatigue and difficulty concentrating - Tingling, numbness, or weakness in the arms or hands - In some cases, cognitive difficulties often referred to as "brain fog"

One of the most important things to understand about whiplash is that symptoms frequently do not appear immediately following the accident.

As described in the scenario above, it is entirely common for a whiplash injury to manifest hours or even a full day after a car accident. This delayed onset catches many accident victims off guard and, unfortunately, leads some to forgo the medical attention because they feel "fine."

How Is Whiplash Diagnosed?

Whiplash is diagnosed by a qualified healthcare professional, such as a medical doctor, chiropractor, or physical therapist with experience in musculoskeletal injuries.

A thorough physical examination will typically be conducted to check the range of motion in the neck, check for areas of tenderness, and evaluate neurological function in the arms and hands.

In many cases, imaging studies are ordered to get a clearer picture of the injury. While X-rays can help rule out fractures or dislocations, MRI scans are particularly useful for identifying soft tissue damage, including injuries to muscles, ligaments, and intervertebral discs, that are not seen on X-rays. CT scans may also be used in more complex cases.

After a car accident, it is absolutely critical that accident victims be checked out by a medical doctor or a chiropractor as soon as possible, even if they feel fine.

Such an evaluation will give an accident victim a formal medical diagnosis, which not only ensures that the victim receives the treatment they need, but it also creates an official record of their injuries.

Documenting an injury, especially done immediately after an accident, is invaluable because it establishes a timeline for an injury in a personal injury claim. It also prevents insurance companies from arguing that the injury was not caused in the accident.

What Are the Treatment Options for Whiplash?

Treatment for whiplash is not one-size-fits-all. The appropriate course of treatment depends on the severity of the injury, the specific body area affected, and the accident victim's overall health and medical history.

That being said, most whiplash treatment plans involve some combination of the following:

Rest and Activity Modification: If you experience symptoms from a whiplash injury, make sure you rest because rest allows the damaged muscles and soft tissues to begin the healing process.

However, it is important to note that prolonged immobility is generally not recommended because it can lead to stiffness and actually slow recovery. Your healthcare provider should guide you on the appropriate balance between rest versus gentle movement.

Ice and Heat Therapy: Allow apply ice to the injured area during the first 24 to 48 hours after the accident as it helps to reduce swelling and inflammation. Do not use heat because it will increase inflammation.

However, after inflammation is reduced, heat therapy may be used to relax tightened muscles and improve circulation to the affected area. Again, check with your healthcare provide as to when heat is appropriate.

Chiropractic Care: Chiropractic treatment is one of the most commonly used and effective treatment for whiplash injuries.

The cervical spine has a natural, gentle curve, known as lordosis, that plays a critical role in distributing the weight of the head and reducing stress on the spine. Simply said, the head is the size of a bowling ball and the curve on the spine allows this "bowling ball's" weight to be distributed on the spine.

Rear-end collisions frequently effect, or more often that not, reverse this curvature of the spine, a condition that places chronic stress on the spine and can lead to long-term degenerative changes if left untreated.

Chiropractic adjustments work to restore proper spinal alignment, i.e. restore the curvature of the spine, reduce nerve irritation, and set up the groundwork for recovery.

Physical Therapy: Physical therapy is another method for dealing with whiplash injuries.

Working with a licensed physical therapist, whiplash victims engage in specific exercises designed to restore range of motion, rebuild strength in the neck and surrounding musculature, and retrain proper posture and movement patterns.

Hands-on techniques such as massage, myofascial release, and ultrasound therapy may also be used to address muscle tension and promote tissue healing.

Pain Management: Depending on the severity of the patient's symptoms, pain management may include over-the-counter anti-inflammatory medications, such as ibuprofen or naproxen, prescription pain relievers, muscle relaxants, or nerve pain medications. In some cases, corticosteroid injections may be recommended to address localized inflammation.

Psychological Support: It is worth noting that serious whiplash injuries can have a significant psychological toll as chronic pain, disrupted sleep, and limitations on daily activities can contribute to anxiety and depression.

A comprehensive treatment plan may include counseling or other mental health support as part of the recovery process.

In the most serious whiplash cases, conservative treatment alone may not be enough. When there is significant structural damage to the spine, such as a herniated disc, spinal instability, or nerve compression that do not respond to conservative (i.e. non-surgical) treatment, surgery may become necessary.

Surgery may include discectomy, spinal fusion, or other surgical techniques aimed to repair damaged structures and stabilize the spine.

It is important to not that surgery is always considered a last resort, and only discussed after all reasonable conservative treatment options have been thoroughly explored and exhausted. The decision to undergo surgery should be collectively made by the injured person (patient) and a qualified spine specialist.

Regardless of the severity of a whiplash injury, one principle holds firm: time matters. Seeking prompt medical attention after a car accident not only gives your body the best possible chance of a full recovery, it also preserves and strengthens your legal rights should you choose to pursue a personal injury claim.
